The Massachusetts Alcoholic Beverages Control Commission has banned the popular Four Loko beverage from store shelves. Massachusetts is the fifth state to ban the popular caffeinated drink-a move which is likely to be adopted by the other states in due time.

Made by Phusion Projects LLC, the alcoholic energy beverage contains guarana and caffeine and has grown in popularity. College kids have especially taken to Four Loco, which is inexpensive and considered potent. However, there have been growing concerns that the combination of alcohol and caffeine makes the drink a dangerous product.

Our Boston products liability lawyers want to remind you that if you or someone you love suffered serious injuries from drinking or eating a tainted or dangerous food product or beverage, you should explore your legal options as soon as possible. Many college campuses have already banned Four Loko. Recently, nine Central Washington University students (all teenagers) were hospitalized with blood-alcohol levels of .12% to 35% (a BAC of 30% is considered possibly deadly) after drinking the caffeinated malt liquor. One of the students almost died. Another group of students were hospitalized at St. Joseph’s University also after drinking Four Loko.

In an unrelated incident, Florida State University Jason Keiran’s family is suing Phusion Projects for his wrongful death. They claim that he shot himself because he drank three cans of Four Loco.

Elsewhere in the US, relatives of another young adult, 21-year-old Courtney Spurry, say she crashed her car after drinking Four Loko. Spurry died from her injuries.

The Food and Drug Administration has sent warning letters to the manufacturers of a number of alcoholic energy drinks. In November, Four Loko announced it would take out the stimulants and caffeine from their beverage.

Toyota, which is facing hundreds of lawsuits in the United States related to unintended acceleration injuries, now needs to fix coolant pumps in 650,000 Prius cars for model years 2004-07. Of those cars, 390,000 are in North America, and 378,000 are in the United States. Since last year, Toyota has recalled 14 million cars across the globe, including 11 million in the United States, for problems like defective gas pedals, floor mats and braking.

The Prius is a hybrid car that switches between a gas engine and an electric motor. In the 2004-07 models, air can get trapped in the coolant pump and cause a malfunction or overheating of the core hybrid system. According to Toyota, no accidents related to the coolant pump have been reported yet. Toyota is calling the push for repairs a “customer satisfaction campaign,” as opposed to a recall.

Toyota will begin notifying United States Prius owners in December and will cover the cost of the repairs.

In recent weeks, a federal judge in California ruled that lawsuits filed after Toyota’s recalls could move forward, while Toyota continued to assert that plaintiffs could not prove that a design defect was to blame for unintended acceleration.

A rollover in Braintree on Tuesday afternoon resulted in a 94-year-old Hull woman being injured, police told the Boston Globe. They said that her vehicle was struck by another one on Quincy Avenue. It came to a stop on its roof, and Braintree firefighters had to help get the woman out of the vehicle. The woman was taken to the South Shore Hospital in Weymouth, and her condition is not currently known. She is in the intensive care unit. The driver of the other car, a 39-year-old woman from Quincy, was cited for a lane violation.

World Against Toys Causing Harm Inc., a Boston nonprofit, has identified the 10 toys it the marketplace that it considers to be the worst in terms of hazards they pose to kids. The list is out just in time for the holiday shopping season.

Pull-Along Caterpillar: Pull string can pose a choking hazard.

Animal Alley Pony: Long, fiber-like hairs can come off easily and may pose an aspiration or ingestion hazard.

Big Bang Rocket: May cause hearing damage if used too close to the ears.

Walkaroo II Aluminum Stilts: Don’ use close to swimming pools, stairs, uneven surfaces, or steep inclines. Falling from the stilts can cause head or other impact injuries.

Toys are made specifically for kids. There is no reason why they should be dangerous enough to cause serious injuries or death to a child. Unfortunately, ever year, there are children who are hurt because a toy or another consumer product proved unsafe for use, malfunctioned, or did not come with the proper warnings.

A young girl stopped breathing while inside a water toy attraction at the Pump ‘n’ Jump store at Independence Mall in Kingston. The store allowed children to climb into and walk or float in an inflatable 6-foot ball. It is a popular toy, and the Cape Cod Mall in Hyannis has a similar ride.
The girl’s condition is unknown, but she was taken to a hospital. The ride has been suspended, and the safety of the water walking balls in under investigation.

Fisher-Price Inc. and the US Consumer Product Safety Commission are recalling over 10 million children’s toys because they pose a serious injury risk to kids.

Included in the recall:

About 7 million Fisher-Price Trike and Tough Trike toddler tricycles: Fisher-Pricea nd CPSC know of at least 10 injury incidents, including six female toddlers who needed medical care after falling on the pretend plastic ignition key, which is located in front of the tricycle seat. A child that sits or falls on or hits the pretend ignition key risks serious injuries, including genital bleeding. 14 models are included in this recall. Another 150,000 tricycles are being recalled in Canada.

Approximately 2.8 million Fisher-Price toys with inflatable balls:

–Baby Playzone™ Crawl & Slide Arcade™
–Baby Playzone™ Crawl & Cruise Playground™

Another 125,000 of these toys are being recalled in Canada.

The valve of the inflatable ball that comes with these toys for infants can come off and become a choking hazard. There are 46 reports of the valve coming off in the US. During 14 incidents, the valve was discovered in a child’s mouth. Three of the kids started to choke.

About 100,000 Fisher-Price Little People Wheelies Stand ‘n Play Rampway: If a wheel from one of the cars comes off, it could pose a choking hazard to young children.

Approximately 950,000 Healthy Care, Easy Clean and Close to Me High Chairs: The pegs on the rear legs of the chairs can cause laceration injuries. The high chairs are also made by Fisher-Price.

There have been 14 reports of such incidents. Seven of the children involved needed stitches. Another 125,000 of the high chairs were recalled in Canada.

Product designers, manufacturers, sellers, and others involved can be held liable for Boston products liability or wrongful death if their product was poorly designed, has a manufacturing defect, came with inadequate operating or assembly instructions, or did not warn about possible dangers and risks associated with using the product. A recent recall of DePuy Orthopedics, Inc.’s Sr XL Acetabular Hip Replacement and ASR Hip Resurfacing Systems products could impact the approximately 93,000 people that have been implanted with one of these medical devices. The recall was announced after the National Joint Registry reported that 1 out 8 patients that had undergone a hip replacement procedure with one of these DePuy products had to go through another procedure within five years.

FDA Adverse Event Reports notes that in just the last two years, the regulatory agency has received over 400 reports involving the DePuy ASR products. The issues appear to be caused by design defects that can result in hip failure or other complications, including bone fractures, dislocation of the implant parts, or the loosening of the hip implant. The metal particles from the implant can also shed into the body, causing other health issues, including bone and tissue damage.

Signs that you may be experiencing problems with your DePuy ASR hip replacement include:

• Hip swelling • Hip pain • Difficulties walking
Learning to use any kind of hip replacement product is challenging enough without compounding any difficulties with further problems that could result in a second surgery or other health issues. Over the weekend, a pilot crashed the helicopter he was operating into a swamp near the MBTA’s commuter rail station in Halifax. As a result of the accident, the pilot suffered from broken bones and serious burns.

According to the authorities, the helicopter was “experimental” and may have been built from a kit.

The aviation accident occurred shortly before 1:30 p.m. on Sunday afternoon. The injured pilot has been identified as a 50-year-old resident of Scituate.

According to a Burlington fire official, six people were injured yesterday afternoon when a deck collapsed at a local home. They had gathered at the residence following a funeral when the deck that they were standing on detached from the residence, falling eight feet.

Four of the injured were taken to hospitals for treatment of cuts, scrapes, and possible broken bones following the Massachusetts fall accident. Two people received treatment at the scene.

A local building inspector is investigating the Burlington, Massachusetts deck collapse. It appears as if the wooden deck rotted away at the section where it connects to the home. Fortunately, no one was standing underneath the deck.

Deck Collapses
Unfortunately, deck collapses are not uncommon. According to the North American Deck and Railing Association, since 2003 thousands of people have been injured and a number of others killed in deck collapse accidents. It is the responsibility of the parties that construct decks to make sure that they are made safely and without defects that could make them a danger to those standing on or under a deck. It is a property owner’s responsibility to make sure that a deck doesn’t pose a Massachusetts premises liability to others. Decks must also be properly maintained to ensure that they stay safe.

Common causes of deck collapses:
• Rotted wood • Corroded hardware • Missing or weak connections • Excessive weight • Poor manufacturing • Failure to meet certain standards of safety
Deck collapses can result in serious injuries for those involved. A person standing on a deck that collapses risks sustaining scrapes, bruises, broken bones, internal injuries, traumatic brain injuries, back injuries, and other injuries. A person standing underneath a collapsing deck may sustain head injuries, crush injuries, or spinal cord injuries. Death is also a possibility in both scenarios.
